Summary: How consent, opt-out and message frequency work for campaigns planned or sent through marketing.pizza, for both our clients and the people who receive their messages.
This policy covers email and SMS campaigns planned, scheduled or sent using marketing.pizza, whether sent by us on a client's instruction or by the client through their own sending infrastructure. It sits alongside our Terms and Privacy Policy.
Marketing messages are only sent to recipients who have given consent appropriate to the channel and the jurisdiction. For SMS in the United States, that means prior express written consent under the TCPA: an affirmative action by the consumer, with clear disclosure of who is messaging them, roughly how often, that message and data rates may apply, and how to stop.
Consent must be separate from any other agreement, never pre-selected, and never a condition of purchase. A phone number given for order fulfilment is not marketing consent.
Every consent record we hold or generate captures the timestamp with timezone, the collection channel and source, the exact disclosure text shown to the consumer, a version identifier for that text, the IP address or terminal identifier, the consenting phone number or email address, and the full history of subsequent opt-out and opt-in events.
Recipients can opt out of text messages at any time by replying STOP to any message, and can reply HELP for help. Opt-outs are honoured immediately and applied across every campaign, journey and location under that account, not just the campaign the message came from. Email recipients can unsubscribe with one click from any marketing message, honoured immediately.
Suppression is enforced at send time against a single authoritative record, so a recipient who opted out cannot be reached by a list that was built before they did.
Message frequency varies by campaign and by recipient. Message and data rates may apply. Contact frequency is capped globally per recipient across every channel and campaign type, so that separate campaigns cannot combine into an unreasonable volume.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, sold to, or transferred to any third parties.
The business sending a campaign is the sender in law and is responsible for the legality of its campaigns, including having valid consent. We provide the consent architecture, record-keeping and suppression enforcement. This policy is a description of how the system operates and is not legal advice.
